Agency implementing law despite legislative efforts to circumvent it Marc L. Songini   July 18, 2007 (Computerworld) -- Despite several state and federal efforts to force noncompliance with the new federal identification law, or Real ID Act, the U.S. Department of Homeland Security (DHS) has continued work on the law's guidelines and warned states that they face consequences for failing to comply. The Real ID Act, passed by Congress in 2005, mandates national standards for all state driver's licenses and other official documents. The DHS hasn't released a final version of the law, but the agency has said that it will require the documents to include a digital photograph and a bar code that can be scanned by electronic readers.

Then it states that hereafter come within the United State.   (i) to have committed, or to pose a significant risk of committing, an act or acts of violence that have the purpose or effect of:              (A) threatening the peace or stability of Iraq or the Government of Iraq; or             RTR NOTE: Who decides what threatens the peace or stability of Iraq or the Government of Iraq?  Could it be “you” for disagreeing with the current administrations policies and being active in trying to change them? (B) undermining efforts to promote economic reconstruction and political reform in Iraq or to provide humanitarian assistance to the Iraqi people;   RTR NOTE: If you want American troops home are you undermining efforts to promote economic reconstruction and political reform in Iraq? There are to many examples we could provide here.   (ii) to have materially assisted, sponsored, or provided financial, material, logistical, or technical support for, or goods or services in support of, such an act or acts of violence or any person whose property and interests in property are blocked pursuant to this order; or   RTR NOTE: How are people going to come here and carry out  acts of violence to undermine the efforts in Iraq? They would be in Iraq doing this. This is another tool to use against Americans.  Vague wording makes you worry who’s hand you shake..   (iii) to be owned or controlled by, or to have acted or purported to act for or on behalf of, directly or indirectly, any person whose property and interests in property are blocked pursuant to this order.   RTR NOTE: If you are involved with anybody they use this order on, you are going down also.   b) The prohibitions in subsection (a) of this section include, but are not limited to, (i) the making of any contribution or provision of funds, goods, or services by, to, or for the benefit of any person whose property and interests in property are blocked pursuant to this order, and (ii) the receipt of any contribution or provision of funds, goods, or services from any such person. I feel this is more a attack on free speech then anything else.. If the President wants anti violence orders to smash the insurgents and terrorists then he should phrase his orders in such a way that is not so vague.   I find it hard to believe that without this order our government does not already have plenty of laws that allow them to go after any such people. This really seems to be an attack on us not them.  Who’s side is our government on? THE NO-CONSPIRACY THEORISTS ...

... WITH CONCRETE ON THEIR MINDS

Hello all ...

I was asked to appear in a television documentary this week for Britain's Channel 4 that asked the question: 'Who is ruling the world?' The programme is being made for young people by the channel's education department and will go out to schools and colleges.

The decision to make the programme came after a survey found that large numbers of young people now mistrust government, authority in general and even Channel 4. What great news this is, given that those in power have shown over and over that they lie to us on a daily basis.

My part in the documentary led to me meeting a university psychology academic called Chris French from Goldsmith's College at the University of London. He's a BA PhD CPsychol FBPsS FRSA. Must be intelligent, then. French has produced some astonishing research. Mind, I use the term 'astonishing', as in 'astonishing that he bothered'. He and his colleagues questioned people about 'conspiracy theories' and this is what they found:

• Those who trust authority are less likely to believe in conspiracies.
• Those who distrust authority are more likely to believe in conspiracies.

Ain't academia great? How would we survive without these guys? Anyone with a brain could have told them what they would find before they even started, because of course that is bound to be true. If you don't trust authority you are going to be more open to claims that they are lying than if you think authority is benign and only there to serve the best interests of the people. Er, and?

As I said to French in our interchange on the programme, the point is not who will, or will not, believe in the conspiracy view of world events. The question is this: are the claims true and supportable by the evidence? In short, is the conspiracy happening or isn't it?

This, however, is too simple and direct for the concrete end of academia which, in my experience, is a very long end indeed. Never mind the evidence, it must be something in people's psyche that gets them to believe in conspiracies. After all, the conspiracies can't be true, because we don't believe them. So, let's have a survey and disappear up our own backsides pouring over the obvious, and let's forget little irrelevant details like whether the conspiracy is happening or not.

French told me they had found that those who believed in 'conspiracy theories' were more likely to be 'delusional' than those who didn't believe them. The psychiatric definition of 'delusional' is: 'A false belief strongly held in spite of invalidating evidence, especially as a symptom of mental illness: delusions of persecution'.

So how come no-conspiracy theorists are not considered 'delusional' when they believed there were weapons of mass destruction in Iraq just because those in authority told them this was the case? Ah, but, you see, not to believe in conspiracies is more credible to academia because it supports the establishment version of events. It is like believing in extraterrestrial life. The idea that life as we know it has only evolved on this tiny little planet and nowhere else is considered credible because that's the establishment's view that people like Chris French are there to serve. Therefore, to believe that given the perceived vastness of space there has to be other life 'out there' is considered 'delusional' - 'He believes in little green men', and all that crap.

There is no better example of this phenomenon that I call 'reverse-credibility', than the Islamic hijackers theory about 9/11. It is credible to believe that nineteen hijackers who struggled to fly one-engined Cessnas at puddle-jumping flying schools could suddenly manifest the ability to fly jumbo jets with the most extraordinary skill. But, to say that this is clearly nonsense is a 'conspiracy theory' that attracts dismissal from people like French. He was trying to defend the official 9/11 story during our chat, including the hijacker-pilots-who-couldn't-fly theory.

I asked him for his definition of delusional with regard to his survey and he said it was those who answered 'yes' to questions like: Do you think that everyone is being tracked by their mobile phone?

Once again, whether they are or not is never addressed by French and company. Only his interpretation of the answer matters. The fact is that everyone can be tracked by their cell phone and many are when they are being particularly targeted. I don't believe that everyone is, because most people are no problem to authority and so there is no point.

But to believe that it might be happening when surveillance is increasing by the day is now considered 'delusional'. French doesn't know if the statement is true or false, but he believes it to be false and so anyone who thinks it might be going on must be delusional because he can't be wrong.

French told me there was no evidence for what I was saying in my books about a global conspiracy to impose an Orwellian state. I asked him the obvious question: Have you read any of them? His answer ... 'No'.

This is absolutely typical of his breed and I have met so many of these academic clones who parrot their song sheet 'science' and song sheet 'psychology'. They are not interested in evidence, only their own theories. Indeed, they are no-conspiracy theorists who never bother to check out the validity of what is being claimed by actually researching the evidence.

I said I couldn't take him seriously when he was saying on one hand that there was no evidence and yet not even bothering to read even one of my books to see what evidence was being presented. 'I knew you would take that line', he said. Well, what other 'line' is there to take in the circumstances?

If someone had rigid views on what it is like to travel by train when they had never been near a railway station, people like French would say they had a psychological flaw. But that's exactly what he and his colleagues do. They have concrete opinions without even a cursory look at the evidence, and then accuse people of being delusional for believing in something when, in the unresearched opinion of people like Chris French, there is no evidence! They are looking themselves in the mirror and they are too full of themselves to see it.

When I challenged French about dismissing evidence that he hadn't even bothered to read, he said he knew what I was saying from articles he had read in the media. Given that we are talking about one of the most miss-represented people of recent times, I had to laugh at the idea that anyone could find out what I was really saying, and on what evidence, from the news media. But, then, from the moment I began talking with the guy, I knew I was in Fairyland.

He told me that my work was based on a document called The Protocols of the Elders of Zion, which he claimed was a 'proven fake'. I asked him how he knew that my books were based on that. He had seen it in the papers. The fact that this was provable nonsense, as a read of my books would immediately confirm, was once again irrelevant to him.

What I found most fascinating was to see this no-conspiracy theorist act in precisely the same way he claims for those 'conspiracy theorists' that he so dismisses.

• He says that people believe in conspiracies without any evidence.
• Yet he believes there is no conspiracy without looking at the evidence.
• He says that 'conspiracy theorists' make everything fit their theory.
• Yet he was constantly trying to find ways to make everything fit his no-conspiracy theory.

Chris French was everything he was accusing others of being. I asked him what he thought of the FBI claim to have found a paper passport from one of the '9/11 hijackers' near the Twin Towers, despite the planes crashing in fireballs, the towers turning to dust and thousands of bodies never being recovered. He told me that he had seen a story once of a gas explosion in a house that had caused lots of damage, but the person inside got out unscathed.

I said that the FBI had never produced the passport and, a year after they called a news conference to announce they had found it, the Bureau had told a television documentary team that the find of a hijacker's passport was 'a rumour that might be true'.

Now French theory one, that the paper passport did actually survive, was in deep trouble and another had to be conjured immediately. Maybe, he said, there had been a mix-up in communication and the people who held the news conference had been told it had been found when it wasn't. Had he ever checked that out? No. Would he ever check it out? No. As long as it could give his no-conspiracy theory an escape route, that's all that concerned him.

The common thread of our conversation was that French had to find a way of explaining everything to fit his theory. Any possibility that events could be orchestrated to achieve an outcome had no chance of breaching his firewall. He accuses others of constructing 'conspiracy theories' to make sense of a complex world when he is constructing no-conspiracy theories in precisely the same way.

French is not alone either. He's a blueprint, a program, which you find in the same positions all over the world. I was on a Canadian television news show a few years ago with a university psychologist straight off the production line that produced Chris French. He said that people believed in conspiracy theories because they had to find a way of making sense of a complex world. That is exactly what French said to me this week almost word-for-word, because they share the same computer reality.

I asked this Canadian guy to tell me about the Bilderberg Group. He wouldn't answer and banged on with his no-conspiracy theory. He then said that if what I was saying was true, why were the authorities allowing me to speak in Vancouver? I pointed out that we had spent the last month changing venues as each one pulled out under pressure not to let me speak and that a book signing at a major bookstore had been banned that very week for the same reason. The guy made a right prat of himself, but walked away oblivious of this fact.

After the filming, Chris French asked me if I would give a talk to the 'Skeptics Society' in a London pub. I said no, because there was no point. The Skeptics Society is a forum for concrete psyches 'devoted to promoting scientific skepticism and resisting the spread of pseudoscience, superstition, and irrational beliefs'. It would be like talking to a wall and I have one in front of me that I can use without any need to travel.

People say it's good to be skeptical, or sceptical as we spell the word in Britain, but it isn't. It is good to question and research, but that's not the same as being sceptical. A sceptic is someone who comes from a fixed position and then filters all evidence to the contrary, and the main method is by always finding another explanation for something, no matter how far fetched and ludicrous. By finding another means of explaining away something that challenges their fixed position, they can maintain the fixed position; and that's the whole idea of the exercise: defending their belief. It is irrelevant if the explanation they come with up is not valid - they never bother to research that. So long as they can find something, anything, that's enough to preserve the perception.

Look at that line again about the Skeptics Society: '... devoted to promoting scientific skepticism and resisting the spread of pseudoscience, superstition, and irrational beliefs'. Who decides what is pseudoscience, superstition, and irrational belief? They do, from their fixed belief in how things are. I have met a number of these people and many of them are utterly desperate to find ways of dismissing anything that is different to the norms that they slavishly worship.

This slavery to 'scientific' and society 'norms' means the sceptics that dismiss conspiracy research, like that related to 9/11, are the same people who attack and ridicule any suggestion of the so-called 'paranormal'. I have found this again and again with these characters. So, I had a right chuckle when I went to Chris French's webpage after our meeting to find out some more background about what he did. This is what I found:

My current research focuses on two main areas. The first is the psychology of paranormal beliefs and of ostensibly paranormal experiences. Although a large proportion of the population believes in the paranormal, the evidence presented to support paranormal claims is generally not very convincing in scientific terms. It would appear that on most (and perhaps all) occasions when individuals claim to have directly experienced the paranormal, plausible non-paranormal alternative explanations can be found.

These alternative accounts often rely on the imperfections in human information-processing studied by cognitive psychologists, such as those related to memory, perception, and judgement. The psychology of deception and self-deception is also of relevance in this area. I often appear on the television and radio offering a sceptical perspective on a variety of paranormal claims. I have recently set up the Anomalistic Psychology Research Unit within the Department to act as a focus for research in this area.

That's what a closed mind does for you. You don't research to discover anew; you 'research' to confirm your current beliefs. Much of academia is another religion, another belief system repelling all borders. Academia often condemns and ridicules religion when it is one and operates in the same way. What unites them all? Concrete minds.

30 to 40 shots were fired outside Ed and Elaine Brown's house last night in what was a probable attempt at provocation to goad the Browns and their supporters into a violent response.

Alex Jones spoke to Elaine Brown at around 11:30pm last night and confirmed that what sounded like automatic weapon fire was heard coming from a wooded area behind the house.

Another supporter of the Browns who was staying on the property in a trailer was also startled when his mobile home was violently pounded on in the middle of the night, but the perpetrator escaped.

According to the Brown's blog, others reported seeing Blackwater vehicles parked around the property on satellite surveillance images of the area.

Danny Riley, a friend of the Browns who is also staying in the house, earlier reported that a vehicle driven by the Plainfield Chief of Police had made its way onto the property and was blocking his exit but fishtailed and suddenly accelerated away from the scene violently.

The Palinfield Police offcie told Riley that they were putting down tracks to check how many vehicles were entering the property.

Frantic calls were made to the New Hampshire authorities throughout the night by concerned radio listeners, but early this morning the police denied any involvement in the incidents.

The events coincided with coordinated hack attacks of the Infowars, Prison Planet and We Are Change websites, which went down just 20 minutes before the gunshots were heard.

Early indications suggest that this was an attempt to provoke the Browns and their supporters into a violent response.

Similar tactics were employed when the Browns held a Live Free Or Die jamboree two weeks ago when a Homeland Security helicopter flew low over the attendees and circled the property .

As ever, we are calling for calm heads on both sides and asking that the authorities leave the Browns alone and avoid needless bloodshed from taking place.

Political Prisoner: Loose Change Producer Korey Rowe Arrested Iraq, Afghanistan veteran handed over to military officials by police under charges of "deserting the Army"

Loose Change producer and Iraq and Afghanistan veteran Korey Rowe has been arrested and handed over to military officials without bail for allegedly "deserting the Army".

According to a report in the New York Daily Star, Rowe was arrested on Monday night at a county Route 47 residence in Oneonta.

Rowe was arrested on a "military warrant" that Devlin said was brought to the attention of deputies by the Oneonta Police Department, who received information from a source outside of that department.

Rowe was living at the Route 47 home, Devlin said.

City police officials who were able to comment on the case were unavailable Tuesday night.

After deputies received the information from Oneonta police, they reached out to the Army, and officials from Fort Knox faxed a copy of the warrant, deputies said.

Arrests and court martials for deserters are incredibly rare and this appears to be an obvious case of political persecution as the Loose Change crew prepare the cinematic release of the final version of their popular documentary.

According to MSNBC, "Despite a rise in desertions from the Army as the Iraq war drags on into a fifth year, the U.S. military does almost nothing to find those who flee and rarely prosecutes those it gets its hands on."

The Army court-martialed just 5% of deserters last year, with that number dropping to just 1 per cent or less for the Navy and the Marines.

Rowe enlisted in the Army in August 2001 and left in June 2005. He has been out of the Army for over two years. He was previously arrested under similar circumstances but was immediately released.

Alex Jones interviewed Rowe at a conference in Chicago last year (watch above), during which he exposed how CNN and the military would stage photo-ops to make it appear as if Al-Qaeda members were being killed in Afghanistan, along with a host of other cover-ups and atrocities.

Video shows Ghraib-like torture by sheriffs lead to man's death, say groups, family

On Feb. 6, 2006, Jessie Lee Williams, Jr., a 40-year-old black man in a Southern Mississippi jail, was allegedly hooded and hog-tied by police, beaten about the head and testicles and ultimately died from blunt injuries to the head.

The coroner determined the death was a homicide. The local sheriff indicated law enforcement agencies were investigating and that the individual targeted by the investigation is “no longer employed by the Harrison County Sheriff’s Department.”

Despite the fact that the beating was videotaped, no arrests have been made.

Williams’ family has filed a $250 million civil suit for damages. Last Friday, the sheriff’s attorney in the Williams case asked the court to halt the civil proceedings until the criminal investigation is complete in order to avoid self-incrimination.

The complaint documents numerous previous incidents of abuse in the Harrison County jail booking room where Williams died, including beatings, hooding, use of a restraint chair – called “the torture chair” or “the devil’s chair” by inmates – and a technique similar to water-boarding where a sheet was wrapped tightly around the head of a man in the restraint chair and water was poured into the breathing hole.

In April, US Attorney Dunn Lampton told reporters, “We’re moving at a good speed.” Lampton told Harrison County Sheriff George Payne not to discuss the investigation with anyone and Payne has not returned RAW STORY’s calls.

US Prisons the Training Ground for Military Detentions?

A recent Amnesty International report covered by RAW STORY revealed that nearly 200 African-American men in a Chicago prison have alleged torture between 1971 and 1991. The report concluded there are troubling similarities between detainee abuse allegations in US military prisons around the world and US prisons at home.

Williams’ treatment, like that of many of those in the Chicago cases, is similar to reports of abuses at Abu Ghraib, the US prison at Guantanamo Bay, Cuba, and other US detention facilities in the Middle East. The nurse’s notes in Williams’ case states that Williams was placed in a restraint chair, hooded, sprayed with pepper spray, and had blood coming from both ears. He was told by the restraining officer that the officer would kill him, after which the man choked him until he couldn’t breathe.

Based on witness statements, the attorney for the Williams’ estate commissioned an artist to create an illustration which shows Williams being carried hooded and hog-tied.

The caption reads, “This picture is a depiction made of the Harrison County Adult Detention Facility's booking room on the night of February 4, 2006, based upon witness statements, in which Jessie Lee Williams, Jr. was hog-tied, shackled (hands to feet), sack on his head, blood dripping from the beating, and carried like a human suitcase – soon to be slammed/dropped on his face – two times.”

Such treatment closely resembles methods depicted in photographs of detainees at Abu Ghraib.

James Johnson, an Australian with a Ph.D. in Mechanical Engineering and a Masters Degree in Psychology, who has been an advisor to the Australian government and has been researching the US penal system for eleven years for a book, says, “I believe that the principal method of torture applied in the prisons is psychological. However outright brutality is used quite regularly.”

Johnson provides examples from letters inmates have written him: solitary confinement, rapes, beatings, use of restraint chairs, hooding, shackling to the floor, sleep deprivation, extreme air-conditioning, reduction of food allowance, refusal of medical treatment, electric cattle prods, TASERs and water-boarding. Williams suffered serious burns on his back from being shot with TASERs.

“Everything you have read about them using in Iraq, Afghanistan, and Guantanamo is used in American prisons,” Johnson avers. “ That is where most of the torturers gain their experience.”

The purpose, he says, is “to destroy the mind.” Johnson notes that all these methods were used “before the official policy of the American administration became known to the public.”

Human rights violations under international law

International human rights lawyer, Dr. Curtis F.J. Doebbler, who practices in the Middle East and teaches law at Tel Aviv University, told RAW STORY that if Williams was killed as the consequence of being beaten by law enforcement authorities, as alleged, “his right to life and right to humane treatment (prohibition of torture) would have been violated under both the International Covenant of Civil and Political Rights and American Declaration on the Rights and Duties of Man.”

“A case could be brought to the United Nations Working Group on Arbitrary Detention or the Inter-American Commission on Human Rights,” Doebbler adds.

After a recent Supreme Court ruling in which the court held that the military tribunals used on enemy combatants at Guantanamo violated the Geneva Conventions and laws of war, the Pentagon pledged to abide by Common Article 3 of the Conventions, which establishes minimum standards of humane treatment for detainees.

Joseph Margulies, the lead counsel in another Guantanamo case in which the Court decided last year that detainees have the right to due process, noted in a Washington Post editorial, “we know what the administration means by humane treatment.”

“These are the same people who said it was humane to hold a prisoner in solitary confinement with no human contact except interrogators and guards until . . . he became delusional,” Margulies wrote. “Then it was humane to subject the same prisoner to an eight-week series of interrogations that lasted 18 to 20 hours a day. Interrogators doused him with water if he fell asleep and forced him to stand at attention for hours at a time if he did not cooperate.”

Even when a detainee’s heartbeat had slowed to 35 beats per minute and he was placed in a doctor’s care, loud music was played in his cell to prevent him from sleeping.

Margulies says, “If this interrogation was not cruel, humiliating and degrading, if it did not offend personal dignity, then the words have no meaning.”

Jailhouse Beating Investigation Nets Four More Arrests

Rick Gaston was once a jail warden. Recently, he ran the Harrison County jail's booking area. Now, Gaston has been linked to the ongoing inmate beating scandal. A federal grand jury indicted Gaston on two counts tied to inmate beatings. It also re-indicted Ryan Teel. And it implicated two other jailers who allegedly had roles in a pattern of inmate abuse. 

Just before federal magistrate John Roper unsealed the five count indictment, the sun burst through oak trees outside Gulfport's federal courthouse. It was symbolic of a new light being shined on the Harrison County beatings investigation.

Cono Caranna is a special prosecutor working with the U.S. Attorney's Office.

"It lets everyone know, as we have said all along, this case has continued to be investigated," Caranna said.

This time, the spotlight was on Gaston. Right before he bonded out of jail, he looked at Judge Roper and said he was "not guilty sir" of the allegations against him. Moments later, Gaston jumped into his pickup truck and started to drive off before media cameras spotted him.

The special prosecutor noted that to this point, Gaston is the highest ranking deputy to be charged in connection with inmate beatings that included the 2006 death of Jessie Lee Williams.

"He had a position of responsibility and leadership," he said.

Yet, a federal grand jury indicted Gaston on one charge of conspiracy to intentionally use excessive force against inmates. And two counts of depriving an individual of his civil rights.

Also named in the indictment was Ryan Teel. He returned to court Friday after the grand jury added to charges to the two counts of inmate abuse he already faces. Teel is now accused of conspiracy to intentionally use excessive force against inmates, depriving Jessie Lee Williams of his civil rights, falsifying records, and violating the civil rights of another defendant. Jim Davis is Teel's attorney.

"We'll defend it just like we're defending the current charge and see where we end up," the defense attorney said.

Two other former Harrison County deputies were also indicted. Like Gaston and Teel, Daniel Evans and Karl Stolze are accused in the count one conspiracy charge.

Nine former deputies have now been implicated in the jailhouse beatings since Jessie Lee Williams died. Morgan Thompson, Dedri Caldwell, Thomas Wills, William Priest and Regina Rhodes have all pleaded guilty to inmate abuse charges, including the abuse that killed Jessie Lee Williams. They're still waiting to be sentenced.

Williams family members noted the ever expanding investigation as they left Friday's arraignment.

"Wait until the final results," one relative said.

Trials for Teel, Gaston and the two other former deputies start May 29th.

Teel has been in custody since his initial indictment last August. He'll remain under home confinement until the trial. The other three defendants were all released Friday on $25,000 bonds.

As part of his bond, Gaston was told he could no longer work for the Harrison County Sheriff's Department. Until Friday, he had been on administrative leave with pay.

Brian 'Head' Welch Explains Why He Left Korn

Guitarist had become sick of 'chasing the almighty buck.'

On Tuesday, Korn's management made a formal announcement that guitarist Brian "Head" Welch was leaving the band to rededicate his life to Christianity. On Thursday night, in an effort to explain his decision to both his fans and his former bandmates, Welch spoke with MTV News.

"I love everybody in the band — I was afraid to leave. It made me sad to think that I would be hurting the band if I left. For the last year and a half, I wanted to leave, but someone would always talk to me and convince me to stay," Welch said. "But I've had a problem with the way things were going since the second record. I mean, we would do things, and I would be like, 'Oh, this is metal! This is the rock and roll life!' But inside, I thought they took it too far. It was a little too crude for me."

Welch said that the statement issued by Korn's management company blew things out of proportion, and that his newfound spirituality was just another step on his path of self-discovery (see "Brian 'Head' Welch Leaves Korn, Citing Moral Objections To Band's Music"). It wasn't the reason he left Korn — the band he helped form in 1993, a band that's sold more than 11 million records in the U.S. He left because he had become sick of "chasing the almighty buck," and felt that being respected by his young daughter was more important than being rich.

"I have a 6-year-old daughter, and I want her to be able to look me in the eye. I'm a single dad, that's what it comes down to," he said. "And the guys were really accommodating when I would tell them that. They'd be like, 'Bring your daughter on tour! We'll work the tour around you.' But that's not the place for a 6-year-old. She would be sitting backstage sometimes, just counting dollars. Because Fieldy would tell her, 'Every time you hear a curse word, you'll get a dollar. It will help us stop cursing.' And at the end of the day, she'd turn to me and be like, 'Look at all my money, Daddy!' "

So after a weekend of soul-searching, coupled with reading from a Bible his friend had leant him, Welch decided it was time to go. And his decision was not a popular one with his bandmates.

"I think it made the guys mad. It confused them. I left at the worst possible time. We got off Sony, and all the money was there, we were going to own all of our songs, but I had to prove to myself that money wasn't my God," he said. "I talked to Jonathan [Davis] and he said, 'I don't get it, man, you're all happy and we're sitting here grieving because our band is breaking up. And I wanted to tell him, 'Well, for years, you guys were out partying while I was sitting on the tour bus wanting to die.' "

Welch also said that for the past month, he's been trying to reach out to the other members of Korn, but has gotten little response. He said he spent his final days in Korn talking with bassist Fieldy, and had even mentioned the songs he'd been recording on his own, which reflected his growing spirituality. Fieldy was less than receptive.

"I just asked Fieldy if he'd be interested in producing some of the stuff I've been working on, but he hasn't called me back in weeks," Welch said. "I mean, I was saying some stuff to him during my final days in Korn, some crazy stuff. But since I've left the band, I've heard nothing from him at all."

Welch's solo material — which will be released under the name "Head" — will not be Christian music. Rather, he said, he wants it to be an "extension of the Korn family."

"I always loved that Korn's music helped kids let out aggression. But with my new music, I want kids to know that there's more out there," he said. "I want to show them there's a light at the end of the pain tunnel. That there's more out there than just aggression. I want to say to them, 'Hey kids, come over here. Let's bounce back and forth and have fun.' "

And yes, Welch does plan on speaking on Sunday at the Valley Bible Fellowship. He's just not certain what he's going to say. He's just going to speak from the heart. And he wants his fans to know that even if they can't make it out to Bakersfield, California, to hear him speak, they can check out his message on his new Web site — www.HeadToChrist.com — which launches Friday (February 25).

"Man, when I get up there onstage, it's going to be me just letting things flow. I have no idea what I'm going to say, it's just going to come out," he said. "I mean, I'm going to be like a kid up there. Because that's really what I am now. I'm a baby Christian."

CAMP PENDLETON, Calif. - A Marine convicted of kidnapping and conspiring to murder an Iraqi civilian who was killed by troops looking for an insurgent will not serve prison time, a military jury decided Friday.

Cpl. Trent Thomas was sentenced to a bad-conduct discharge and reduced pay. He could have received life in prison for his role in the April 2006 killing of the retired Iraqi policeman in the village of Hamdania.

Thomas, of Madison, Ill., was among seven Marines and a Navy corpsman accused of snatching 52-year-old Hashim Ibrahim Awad from his house, marching him to a nearby ditch and shooting him after they botched an attempt to capture a suspected insurgent.

Prosecutors said squad members tried to cover up the killing by planting a shovel and AK-47 by Awad's body to make it look like he was an insurgent planting a bomb.

A military jury of three officers and six enlisted Marines deliberated Thomas' sentence for less than an hour before returning its decision.

On Wednesday, the jury convicted Thomas, 25, of kidnapping and conspiracy and acquitted him of other charges, including the most serious, premeditated murder.

Prosecutors had recommended Thomas be sentenced to 15 years in prison with a dishonorable discharge, reduction in pay and forfeiture.

Thomas' attorneys argued that their client was only following orders from his squad leader and asked that he be credited for the 519 days he has already served in the brig and be returned to active duty.

"We failed him as a Marine Corps, because under good leadership, this Marine would not be here today," Maj. Haytham Faraj told the court. "Consider where the responsibility lies."

Thomas had agreed in January to plead guilty in the case, but withdrew the guilty pleas on the eve of sentencing in February. His attorney, Victor Kelley, said that pretrial agreement had called for 12 years in prison.

On Thursday, Thomas told the court he wanted to continue serving.

"I've never been good at anything until I came to the Marine Corps," said Thomas, who served three combat tours in Iraq and was awarded a Purple Heart for the 2004 siege on Fallujah. "It's pretty obvious Michael Jordan was meant to play basketball. Tiger Woods was meant to play golf. The Marine Corps, it's me."

The final terms of Thomas' punishment are subject to review by Lt. Gen. James Mattis, the commanding general overseeing the case, but he can only reduce the sentence.

Four other Marines and the sailor charged pleaded guilty to reduced charges in exchange for testimony. A court-martial began Friday in a Camp Pendleton courtroom for Thomas' squadmate Cpl. Marshall L. Magincalda. Proceedings are scheduled to begin next week in the case of squad leader Sgt. Lawrence Hutchins III.
